  Maybe it sounds too good to be true--the profit that real estate investors make from buying houses and immediately selling them for a higher price (a technique known as "flipping" the property).    Hard Money Lending in a Nutshell

   Hard money loans are a form of real estate financing that is virtually risk-free for both the borrower and the private lender, because hard money loans are asset-based--the quick-sale value of the house serves as the collateral. Many times, there's no need for a personal guarantor! Hard money loans differ from conventional mortgages in that the money comes from one or more private lenders, not from an institution such as a bank or mortgage company. Hard money lenders are a very specialized type of mortgage broker, and must understand and abide by federal and state predatory lending laws. In addition, they often have access to private money that is ready to invest!

   The hard money lender can either work with private lenders individually, raising money from them for specific deals; or can lend private money that the investors have already pooled, with specifications about which types of loans the funds can be used for. In the latter case, the hard money lender collects the funds for the "pool" and is able to make decisions on most new loan requests without approaching the private lenders individually.

   Whether the private lenders are involved personally or through a pool, the mortgage payments are often collected by a loan servicing company. This company then either sends checks to the private lenders or to the private money pool, which then issues checks back to the private lenders for a percentage of the collections.

   How to Profit from Hard Money Loans    There are many scenarios in which a real estate investor can use hard money lending to finance real estate deals and make a substantial profit. For example, the real estate investor might buy a pre-foreclosure property directly from the buyer, who will likely settle for a lower price in order to make a quick sale. Or the investor might buy a bank-owned property, which can lead to a very good deal because banks often don't know how much such properties are worth.

   Another very popular technique is the "fix-and-flip"--buying a distressed property, rehabbing it and selling it.

   Finding a Hard Money Lender

   It can be difficult to find a hard money lender, because most of the mortgage brokers that advertise their services are conventional mortgage brokers. But private lenders will not use a conventional mortgage broker, because doing so might jeopardize the loan. So where does the real estate investor look?

   You can find hard money lenders by asking closing attorneys, real estate attorneys, other mortgage brokers, or insurance agents. Once you do find someone who is a hard money lender, make sure they really are by asking a few questions.

   For instance, ask if they are familiar with predatory lending laws (hard money lenders are required to be familiar with both state and federal predatory lending laws and to keep up with changes in those laws). Ask them straight out if they deal directly with private lenders, or go through another broker. The person who deals directly with the private lenders is the person you'll want to get to know.
